GDPR
Jiří Lojda, LL.M. EUR., Ph.D., attorney-at-law, with its registered office at Nemocnice 582/8, 190 00 Prague 9 – Vysočany, Czech Republic, Czech Bar Association Reg. No.: 19263, Company ID No.: 73927368 (hereinafter referred to as the “Attorney“) hereby informs you in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 – General Regulation on the protection of personal data (hereinafter referred to as the “GDPR“) on the processing of personal data.
The Attorney processes personal data of clients and persons acting on behalf of clients in connection with the performance of its business activities (advocacy). These data are:
- Identification data (name, surname, address, ID number, date of birth or ID card or passport number)
- Data for issuing tax documents (name and surname, company, ID number, address of residence or registered office, data on entry in public records, account number, VAT number)
- Certain data on administrative or judicial proceedings (information on initiated, ongoing or terminated judicial or administrative proceedings conducted against the client or with an entity with which the client has a certain legal or factual relationship, or in which the client participates as a witness, expert, etc.)
- Some data about the client’s business activities (subject of business, registered office and contact details of the establishment, etc.)
- Data on the communication between the data subject and the Attorney, including contact details (telephone number, e-mail, data box ID, fax number, etc.)
The above data are obtained by the Attorney from the client when concluding a contract for the provision of legal services or during its performance, as well as from public sources such as the Trade Register, the Commercial Register or the Land Registry, etc., as well as from public authorities. These data are processed for the individual purposes listed below, and the Attorney does not process these data automatically:
- Providing legal services to the client
- Conclusion of a contractual relationship between the Client and the Attorney for the purpose of providing legal services and performance of this contractual relationship, including communication for the purpose of performing this contractual relationship
- Representing a client in court or administrative proceedings, or in dealings with other natural or legal persons
- Fulfilment of the Attorney’s obligations stipulated by legal regulations (tax, accounting, AML, etc.)
- To protect the legitimate interests of the Attorney
- For the purpose of offering legal services or participation in educational activities organized by the Attorney, or in which the Attorney participates, and sending commercial communications
The Attorney’s personal data is handled by the Attorney with care and in accordance with the applicable legislation, the Attorney processes personal data only to the extent necessary for one of the above-mentioned purposes and for the period necessary for this purpose.
The Attorney is entitled, to the extent necessary, to hand over the Client’s personal data to entities involved in the provision of legal services (experts, interpreters, postal service providers or electronic communication services, etc.) to public authorities (courts, administrative bodies) if it is necessary to defend the client’s interests or if the Attorney is required to do so by a legal regulation or a decision of a public authority issued on the basis of it, alternatively, the Attorney is entitled to transfer this data to entities that participate in the operation of the Attorney’s business (accountants, tax advisors, cooperating attorneys, etc.).
The Attorney processes the Client’s personal data for the period for which the contractual relationship between the Client and the Client lasts, or for the period for which the Attorney is obliged to defend the Client’s interests even after the termination of the contractual relationship between the Client and the Attorney. The Attorney also processes personal data for the period for which it is necessary to protect its legitimate interests (filing of tax returns, legal obligation to archive data on transactions and their parties, etc.).
In accordance with the GDPR, the Client has the following rights vis-à-vis the Attorney regarding their personal data:
- The right of access to your personal data and the right to confirmation issued by the Attorney as to whether or not the client’s personal data are being processed and to a copy of the processed personal data (Article 15 of the GDPR)
- Right to rectification of personal data if there are inaccuracies in the client’s personal data, or to completion of personal data (Article 16 of the GDPR)
- The right to erasure of personal data, if there are grounds for doing so pursuant to Article 17 of the GDPR, in particular if the consent to the processing of personal data has been validly withdrawn or is no longer necessary for the fulfilment of the intended purpose of the processing and unless there is a legally recognized reason for which the deletion may be refused
- Right to data portability in the cases referred to in Article 20 of the GDPR
- Right to object to the processing of personal data pursuant to Article 21 of the GDPR
- The right to withdraw consent to the processing of personal data at any time. However, the withdrawal of consent does not affect the processing of personal data that took place before the withdrawal of consent. Consent to the processing of personal data may be withdrawn in writing or by e-mail at one of the Attorney’s contacts listed below.
- The right to lodge a complaint with the supervisory authority – the Office for Personal Data Protection, as provided below.
